Preamble

These General Terms and Conditions of Sale (hereinafter referred to as the "Terms") govern the contractual relations between the company Lauriane L'Eplattenier, operating under the trade name "Elindrayoga" (hereinafter "the Seller"), and any natural or legal person placing an order via the website www.elindrayoga.com (hereinafter "the Customer"). Any order placed on the Site implies full and unconditional acceptance of these Terms.

Article 2 — Scope and Governing Law

The Site is operated from Switzerland. These Terms are governed by Swiss law, specifically the Swiss Code of Obligations (CO) and the Federal Act against Unfair Competition (UCA/LCD).

When the Customer has their habitual residence in a member state of the European Union, they additionally benefit from mandatory protective consumer legislation of their country of residence which cannot be excluded by these Terms (notably regarding the right of withdrawal, legal guarantee of conformity, and unfair contract terms).

Article 3 — Products

The products offered for sale are described and presented with the greatest possible accuracy. However, photographs and descriptions do not have absolute contractual value; minor variations in color or appearance may occur, particularly due to display settings on the Customer's device.

The Seller reserves the right to modify the range of products offered at any time, without affecting orders already confirmed.

Article 4 — Orders

Any order placed on the Site constitutes a purchase offer by the Customer. The contract is only definitively concluded upon written confirmation (confirmation email) from the Seller and receipt of payment.

The Seller reserves the right to refuse or cancel any order for a legitimate reason (unavailability of the product, obvious pricing error, suspected fraud). The Customer will be informed as soon as possible and, if applicable, fully refunded.

Article 5 — Prices and Payment

Prices are stated in Swiss Francs (CHF) or Euros (EUR) depending on the selected delivery country, inclusive of all taxes unless otherwise stated, excluding delivery costs which are specified before final order validation.

Payment is due in full at the time of ordering, via the payment methods offered on the Site. Prices and offers are subject to change; the applicable price is the one in effect at the time of order validation.

Article 6 — Delivery

Delivery times indicated on the Site are provided for guidance purposes only. The Seller makes every effort to meet these timeframes but cannot be held liable for delays attributable to the carrier or to circumstances beyond its reasonable control.

The transfer of risk relating to the product occurs upon delivery of the package to the Customer or to any third party designated by them, in accordance with applicable law.

Article 7 — Right of Withdrawal (EU Customers)

In accordance with applicable European regulations for Customers residing in the EU, the Customer has 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to provide any reason or pay any penalties, except, where applicable, for return shipping costs.

To exercise this right, the Customer may use the withdrawal form available on the Site or notify their decision by email to info@elindrayoga.com. The refund will be made within a maximum of 14 days from receipt of the notification, or from receipt of the returned product, whichever is later.

Products must be returned unworn, unwashed, with their original tags attached, and in a condition that allows them to be resold.

As part of processing withdrawal requests, we use the application Revoq – EU Withdrawal-Button (Jonas Busch, hello@buschbytes.com). This application processes the following customer data: name, email, order number, and concerned items. Data is hosted in Europe (Germany/Netherlands) via Supabase and Fly.io. Article 8 — Legal Warranty of Conformity

The Seller remains bound by applicable statutory warranties regarding defects in the item sold, in accordance with applicable law (warranty against defects pursuant to Articles 197 et seq. of the Swiss Code of Obligations, and/or the legal guarantee of conformity for consumer Customers residing in the EU).

Nothing in these Terms excludes or limits these mandatory statutory rights. In the event of a proven defect not attributable to normal wear and tear or misuse, the Customer may request repair, replacement, a price reduction, or a refund of the product, in accordance with applicable law.

Article 9 — Liability

The Seller undertakes to exercise due care and diligence in preparing and delivering orders. The Seller cannot be held liable for damages resulting from improper use of the product contrary to its intended purpose, or due to a force majeure event.

Nothing in these Terms excludes or limits the Seller's liability for intent, gross negligence, or personal injury, to the extent that such exclusion would violate mandatory applicable law.

Article 10 — Personal Data

The processing of the Customer's personal data is detailed in the Site's Privacy Policy, accessible at www.elindrayoga.com/policies/privacy-policy, which complies with the Swiss Federal Act on Data Protection (FADP/LPD) and, where applicable, the General Data Protection Regulation (GDPR) for Customers residing in the EU.

Article 11 — Intellectual Property

All elements of the Site (texts, images, logos, designs, "Elindrayoga" trademark) are protected by intellectual property rights and remain the exclusive property of the Seller or its partners. Any unauthorized reproduction or use is strictly prohibited.

Article 12 — Complaints and Dispute Resolution

Any complaint may be sent to: info@elindrayoga.com.

For Customers residing in the EU, in accordance with online dispute resolution regulations, the European Online Dispute Resolution platform is accessible at: https://ec.europa.eu/consumers/odr.

In the absence of an amicable resolution, and subject to mandatory protective statutory provisions applicable to consumer Customers, the courts at the Seller's registered office shall have exclusive jurisdiction, and Swiss law shall apply.

Article 13 — Amendments to the Terms

The Seller reserves the right to modify these Terms at any time. The applicable Terms are those in force on the date the order is placed.
